Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without lawful basis.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The case originates in a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. After his return to the United States to answer alien smuggling allegations, he was held in immigration custody.
In her decision, the court pointed out that the authorities does not have a current removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
